01Who we are, and what these Terms cover
Bua is a web platform built for Gaelic games teams. It is used in a browser at platform.team-bua.com and is also available as an app for iPhone and Android.
Players can use Bua to interact with their team, confirm availability, respond to sessions, record information about injuries and wellbeing, and communicate with other authorised members of their team. Coaches, managers, strength and conditioning personnel, physiotherapists or medical staff and team administrators may use Bua to organise squads, schedule sessions, record attendance, communicate and, where authorised, view information supplied by players.
These Terms govern your access to and use of Bua.
When we say:
“Bua”, “we”, “us” or “our” we mean Bua Sports Technologies Limited, a company registered in Ireland (CRO number 826235).
“you” or “User” means the individual using Bua.
“Player” means a User who has been given a player role within a Team.
“Team” means the club, county, college, squad or other Gaelic games setup through which you are invited to use Bua.
“Team Administrator” means a person authorised by a Team to manage membership, roles, sessions or other administrative functions within Bua.
“Authorised Staff” may include coaches, managers, strength and conditioning personnel, physiotherapists, medical personnel and other persons given an appropriate role by the Team.
“User Content” means information, messages, photographs, files, injury updates, notes or other material uploaded, entered, sent or otherwise provided through Bua by a User.
Some aspects of the relationship between Bua and your Team may also be governed by a separate pilot, customer, data-processing or commercial agreement. Those arrangements do not remove any rights you have under these Terms or applicable law.
02What Bua is
Bua is a team-management and communication tool. Depending on the features made available to your Team, Bua may allow Users to:
- join and participate in an invitation-only Team;
- maintain a basic account and profile;
- view scheduled training sessions, matches or other Team events;
- confirm availability;
- receive session reminders;
- record or view attendance;
- communicate through Team channels or private messages;
- complete check-ins relating to matters such as soreness, fatigue, sleep, mood, illness or availability;
- record and update injury or rehabilitation information;
- upload text or photographs relating to an injury where that feature is enabled; and
- use other Team-management features that Bua introduces from time to time.
Different Users will see different features and information depending on the role assigned to them.
Bua is not intended to replace the judgement of coaches, medical professionals or other suitably qualified people.
03Accepting these Terms
You must accept these Terms before using Bua.
You enter into a contract with Bua when you create or activate your account and positively accept these Terms through the Bua app or another acceptance process we provide.
Electronic acceptance is intended to have the same effect as accepting a contract in writing.
If you do not agree to these Terms, you should not create or use a Bua account.
We will record information such as the version of the Terms you accepted and the date and time of acceptance.
Privacy consent is separate
Accepting these Terms is not consent to the processing of health data or other processing that requires consent under data protection law.
Where Bua or your Team requires your consent for a particular type of processing, including the processing of health information where consent is relied upon, that consent must be requested separately.
You may be able to use features such as scheduling, attendance and messaging without choosing to provide health information, as explained in the Bua Privacy Policy.
04Who can use Bua
Bua is a closed, invitation-only platform. There is no general public registration.
You may use Bua only where:
- you have been invited or authorised by an eligible Team;
- the information you provide when activating your account is accurate;
- you use the account for yourself and not on behalf of another individual unless Bua expressly permits this;
- you comply with these Terms; and
- you satisfy Bua's applicable age requirements.
Age
Bua is for people aged 16 or over. You must not use Bua if you are under 16, and Teams must not invite anyone under 16.
If you are 16 or 17:
- your Team is responsible for making sure your use of Bua follows its safeguarding policies, including any requirement for your parent or guardian’s consent; and
- Bua may ask for reasonable evidence of your age, and may suspend an account where we believe a User is under 16.
Bua may introduce a separate process for younger Users in future. We will not do so simply by changing the wording of these Terms: the product, safeguarding, privacy and consent arrangements must first be appropriate for those Users.
05Accounts, invitations and Team membership
Your Bua account is personal to you.
You must:
- provide accurate and reasonably current account information;
- keep your login details secure;
- not allow another person to use your account;
- take reasonable steps to protect any device through which you access Bua; and
- tell us promptly if you believe your account has been accessed without permission.
You are responsible for activity carried out through your account where that activity results from your failure to take reasonable steps to protect your login details. This does not make you responsible for unauthorised access caused by Bua's systems or matters outside your reasonable control.
Invitations
A Team Administrator may provide Bua with limited information needed to invite you, such as your name, email address, squad and role.
An invitation does not give you permanent access to a Team. Your Team may add, change or remove membership or roles where it is entitled to do so.
Leaving a Team
If you leave a club, squad or other Team, your Team access may be removed.
Removal from a Team does not necessarily mean that every item of information connected with that Team is immediately deleted. How account data and Team-controlled information are retained or deleted is explained in the Bua Privacy Policy and, where relevant, the agreement between Bua and the Team.
06User roles and Team Administrators
Bua allows Teams to allocate different roles and permissions.
A Team Administrator may, depending on the functions enabled:
- invite or remove Team members;
- assign or change roles;
- create sessions or events;
- invite particular Players or squads;
- record or manage attendance;
- manage communication channels; and
- decide which appropriately authorised staff members receive access to particular Team information.
Your Team, not Bua, decides who should hold a Team role and what sporting or operational responsibilities that person has.
Bua provides the technical permissions associated with each role. Unless we expressly tell you otherwise, Bua does not independently verify that a person described within the app as a coach, physiotherapist, medical professional, S&C coach or other specialist holds a particular professional qualification or registration.
A Team Administrator is not an employee, representative or agent of Bua merely because they administer a Team through the app.
Team Administrators must only assign permissions to people who genuinely require them.
07Using Bua
You may use Bua only for its intended Team, sporting, communication and player-management purposes.
You must use information made available through Bua responsibly.
In particular, access to information through your Team role does not give you permission to:
- use it for an unrelated purpose;
- distribute it outside the Team without authority;
- publish it on social media;
- use it to embarrass, harass or target another person;
- access another person's information out of curiosity rather than a legitimate Team purpose; or
- retain or copy sensitive information once you no longer have a proper reason to hold it.
Where your role gives you access to confidential Team, injury or wellbeing information, you are expected to treat that information accordingly.
08Injury, wellness and health information
Bua includes features that may allow Players and Authorised Staff to record information about injuries, rehabilitation, wellness, availability and return-to-play status.
This information can be important and sensitive. Users should therefore understand what Bua does — and what it does not do.
Bua is a technology platform
Bua:
- does not diagnose an injury, illness or medical condition;
- does not assess the clinical seriousness of an injury;
- does not prescribe or recommend treatment;
- does not provide medical advice;
- does not replace a doctor, physiotherapist or other appropriately qualified professional;
- does not independently determine whether a Player is fit to train or compete;
- does not make return-to-play decisions; and
- does not make Team selection decisions.
Information shown in Bua about a Player's condition is based principally on information entered by that Player or by appropriately authorised Team personnel.
Unless expressly stated otherwise for a future feature, Bua does not independently verify the clinical accuracy of that information.
Decisions remain human decisions
A check-in, injury entry, status indicator or other information displayed within Bua should be treated as one source of information, not as a clinical conclusion.
Decisions about diagnosis, treatment, rehabilitation, training load, participation, return to play or Player welfare should be made by the appropriate person having regard to the circumstances and, where necessary, professional medical advice.
If you are injured, unwell or concerned about your health, you should seek appropriate professional advice rather than relying on Bua.
Emergencies
Bua is not an emergency service and must not be used to request emergency medical help.
If you or another person may require urgent medical assistance, contact the appropriate emergency services or healthcare provider.
Accuracy
Players should provide injury and wellbeing information honestly and as accurately as they reasonably can.
Authorised Staff should take reasonable care when adding notes or changing information about another User.
Bua cannot guarantee that information supplied by a User or Team member is complete, current or medically correct.
09Health-data choice
Health information receives additional protection under data protection law.
Where health information is processed on the basis of your explicit consent, that consent will be requested separately from these Terms.
Withdrawing health-data consent does not by itself terminate your Bua account.
Consistently with the Bua Privacy Policy, Bua is designed so that Users can continue to use non-health features such as Team messaging, attendance and scheduling without being required by Bua to provide health information.
A Team must not use refusal or withdrawal of health-data consent as a means of penalising a Player where the Team has agreed with Bua that it will not do so.
Further details are in the Bua Privacy Policy.
10Messaging and User Content
Bua allows Users to communicate within their Team.
Depending on the feature and your role, this may include Team channels, group communications and private messages.
You remain responsible for the content you send or upload.
You should assume that anything you send to another User may be read, saved or disclosed by that User. Bua's technical access controls reduce access but cannot control what another authorised recipient does after receiving information.
Do not include sensitive personal or health information in an ordinary message unless it is genuinely necessary and appropriate to do so.
Your Content
As between you and Bua, you retain any intellectual property rights you have in User Content.
These Terms do not transfer ownership of your photographs, messages, notes or other original content to Bua.
You must have the right to upload any User Content you provide. If it includes information or material belonging to another person, you must have an appropriate basis or authority for providing it.
11The limited licence you give Bua
Bua needs limited rights to technically handle User Content in order to operate the service.
When you submit User Content, you give Bua a non-exclusive, royalty-free licence, for as long as reasonably required, to host, store, reproduce, transmit, display and technically process that content only to the extent necessary to:
- provide the Bua features you or your Team use;
- make the content available to authorised recipients;
- maintain, secure and support the service;
- investigate misuse or technical problems;
- comply with applicable law; and
- exercise or defend legal rights where necessary.
This licence does not give Bua a general right to use your private Team content for advertising, promotion or unrelated commercial purposes.
It ends when Bua no longer requires the content for those purposes, subject to legitimate retention, backup and legal requirements described in the Privacy Policy.
Where your Team rather than you owns particular content or rights in it, Bua's rights may instead arise under its agreement with that Team.
12Acceptable use
Bua should be a useful and respectful environment for Teams.
You must not use Bua to:
- threaten, bully, harass or abuse another person;
- send discriminatory, hateful, sexually abusive or seriously offensive material;
- share unlawful material;
- impersonate another person or deliberately misrepresent your role;
- disclose another person's confidential, medical or private information without authority;
- upload photographs or information about another person where you have no proper basis to do so;
- stalk or systematically monitor another User for an improper purpose;
- distribute spam or unsolicited commercial promotions;
- introduce malware, malicious code or harmful files;
- attempt to bypass authentication or security controls;
- access an account, Team, database or information you are not authorised to access;
- scrape, harvest or systematically extract Bua data;
- interfere with the operation or security of Bua;
- test for vulnerabilities without Bua's written permission;
- copy, sell, sublicense or commercially exploit Bua or access to Bua;
- reverse engineer, decompile or attempt to obtain Bua source code except where applicable law expressly allows that activity and does not permit it to be restricted;
- use automated tools in a way that places an unreasonable load on Bua;
- use information obtained through Bua to facilitate fraud or another unlawful activity; or
- encourage another person to do any of these things.
A sporting disagreement, selection decision or reasonable Team-management communication is not automatically a breach of these Terms. Context matters.
13Reporting and moderation
If you believe content or conduct on Bua is unlawful, seriously abusive, unsafe or in breach of these Terms, you can report it to:
Where an in-app reporting mechanism is introduced, you may also use that mechanism.
We may review a report and take proportionate action where appropriate. That can include:
- taking no action where there is insufficient basis;
- asking for more information;
- restricting access to particular material;
- removing content;
- warning a User;
- temporarily restricting an account;
- suspending or terminating an account; or
- referring a matter to a Team, appropriate authority or emergency service where there is a lawful and appropriate reason to do so.
We are not obliged to resolve sporting, selection, disciplinary or interpersonal disputes that properly belong to the Team.
Where required by applicable law, we will provide Users with information about moderation decisions and available review or redress processes.
14Privacy and personal data
Your use of Bua involves the processing of personal data.
The Bua Privacy Policy explains:
- what information is collected;
- when Bua acts as a controller;
- when Bua acts as a processor for your Team;
- how health information is handled;
- who may receive information;
- retention;
- security;
- international transfers, where relevant;
- your data protection rights; and
- how to contact Bua or the Data Protection Commission.
Our Privacy Policy is available at https://team-bua.com/privacy and in the Bua app.
These Terms do not replace the Privacy Policy.
Acceptance of these Terms must not be treated as consent for any separate processing that legally requires consent.
Your Team is generally responsible for decisions about why Team-entered information such as check-ins, injury logs, attendance, availability and Team messages is collected and who should be able to access it. Bua provides the system and processes that information on the Team's behalf where the Privacy Policy describes Bua as processor.
Bua remains responsible for the processing activities for which it is itself controller.
15Bua's intellectual property
Bua and its licensors own the intellectual property rights in the Bua platform and materials created by or for Bua, including, as applicable:
- software and source code;
- application architecture;
- interface and design elements;
- databases and technical structures;
- Bua branding and logos;
- written Bua content;
- graphics and other assets; and
- improvements and updates.
This does not include User Content merely because it is uploaded to Bua.
No ownership in Bua's intellectual property passes to you under these Terms.
16Your licence to use the app
While your account remains authorised, Bua gives you a limited, personal, non-exclusive, non-transferable licence to install, access and use Bua for its intended purpose and in accordance with these Terms.
The licence does not permit you to:
- sell or commercially license access to Bua;
- make copies except where technically necessary for permitted use;
- remove intellectual-property notices;
- create a competing product by copying protected parts of Bua; or
- otherwise use Bua outside the rights granted by these Terms.
The licence ends when your right to use Bua ends.
Nothing in this section restricts a right that applicable law says cannot be restricted.
17Suggestions and feedback
We welcome feedback about Bua.
If you voluntarily send us an idea, bug report or suggestion, you give us permission to consider and use that feedback to improve Bua without being required to pay you.
This does not transfer ownership of unrelated confidential material, existing intellectual property or User Content to Bua.
If you are sharing information that you regard as confidential business information, tell us before sending it so that appropriate arrangements can be considered.
18Third-party services
Bua relies on third-party technology to operate parts of the service. This may include hosting, file storage, push notifications, email, security, operating systems and app-distribution services.
Some third-party services have their own terms.
Bua is responsible for its own obligations to you and does not use this section to avoid responsibility for a third party where, under applicable law, Bua remains responsible for the service supplied to you.
However, Bua cannot control matters genuinely outside its reasonable control, such as a failure of your internet connection, your device, your mobile network or an external service that is not under Bua's control.
Our use of processors handling personal data is explained in the Privacy Policy.
19Browsers, app stores and devices
Bua is provided primarily as a web app at platform.team-bua.com. The iPhone and Android apps may also be made available through Apple, Google or another authorised application marketplace.
Your use of the marketplace itself may be subject to separate terms between you and that provider.
Those providers are not responsible for Bua's obligations to you merely because they distribute the app.
You are responsible for using a compatible device and a supported browser or operating system.
Bua may stop supporting an old app, browser or operating-system version where reasonably necessary for security, compatibility or technical reasons. Where practicable, we will provide reasonable information about material compatibility changes.
Bua is available as a web app at platform.team-bua.com, on iPhone through Apple’s App Store, and on Android through Google Play.
20Availability, maintenance and security
We aim to make Bua reliably available, but we do not promise that it will operate without interruption at every moment.
Bua may occasionally be unavailable because of:
- maintenance;
- security work;
- software updates;
- third-party infrastructure issues;
- faults;
- events outside our reasonable control; or
- urgent action required to protect Users or data.
We will use reasonable care and skill in providing Bua and will take reasonable steps to address material faults for which we are responsible.
Where reasonably practicable, planned maintenance likely to cause material disruption will be communicated in advance.
No internet-connected service can be guaranteed completely secure or error-free.
21Updates
Bua may provide technical, functional and security updates.
The web app updates automatically. For the iPhone and Android apps, you should install updates within a reasonable period where they are required to maintain security, compatibility or proper operation.
An update may be necessary because:
- a browser or operating system changes;
- a security vulnerability is identified;
- a third-party service changes;
- applicable law changes;
- a bug needs to be corrected; or
- Bua's functionality is legitimately developed.
We will not deliberately describe a materially reduced service as an ordinary technical update in order to avoid your statutory rights.
22Changes to Bua
Bua is an early-stage product and will develop.
We may add, change or remove features where reasonably necessary for:
- product development;
- security;
- legal or regulatory compliance;
- technical compatibility;
- preventing misuse;
- improving performance or usability; or
- a reasonable change to Bua's service model.
Where a modification materially and negatively affects a consumer's access to or use of an ongoing digital service, Bua will provide the notice, information and termination rights required by applicable consumer law.
We will not charge you an additional fee merely because of a change unless a paid service has first been properly offered and agreed.
Major new functionality — particularly payments, AI-based decision tools, public social features or medical/diagnostic functionality — may require separate or updated terms before it is introduced.
23Pilot and free access
The current Bua model is intended to include pilot access for selected Teams.
Unless you are expressly told otherwise before agreeing to a separate paid service, individual Users are not charged a subscription fee under these Terms.
A Team may have a separate pilot or commercial arrangement with Bua. That does not create a payment obligation for an individual Player merely because the Player is invited to the Team.
If Bua later introduces paid subscriptions or paid individual features, those services will not be governed solely by this section. Before any payment obligation is created, Bua will provide the relevant price, billing period, renewal terms, cancellation information and other information required by applicable law.
24Ending your account
You may stop using Bua at any time.
You may request closure of your account through any account-deletion function provided in the app or by contacting us at:
Stopping use of Bua and exercising a data-protection right are not necessarily the same thing. The Privacy Policy explains what happens to personal data when an account closes.
A Team may also remove your access to its Team environment where, for example:
- you are no longer a member of the squad;
- your role changes;
- your Team stops using Bua; or
- the Team is otherwise entitled to end your access.
Your statutory rights remain unaffected.
25Suspension and termination by Bua
We may temporarily restrict or suspend access where reasonably necessary because:
- there is evidence of serious or repeated breach of these Terms;
- an account appears compromised;
- access creates a genuine security risk;
- we reasonably believe Bua is being used unlawfully;
- continued access could expose another person to serious harm;
- a Team confirms that you are no longer authorised to access its environment;
- we are legally required to restrict access; or
- Bua or a relevant feature is being discontinued.
Where the issue is capable of being resolved and circumstances allow, we will normally give you a reasonable opportunity to address it.
We may act without advance notice where immediate action is reasonably necessary for security, safety, prevention of unlawful activity or compliance with law.
Where appropriate and legally required, we will explain a suspension or termination decision and any way to challenge it.
We will not terminate or suspend a consumer account arbitrarily.
26If Bua or a Team relationship ends
If your account or access ends:
- your licence to use Bua ends;
- you must stop accessing areas you are no longer authorised to use;
- Team data will be dealt with in accordance with the Privacy Policy and the applicable Team arrangements;
- legitimate legal, security or dispute records may be retained where permitted or required; and
- provisions of these Terms that logically continue after termination, including intellectual-property and liability provisions, continue to the extent necessary.
Where applicable consumer law requires Bua to make User-created content available to you following termination, we will comply with those requirements.
27Consumer rights
Nothing in these Terms limits any consumer right or remedy that applicable law does not permit us to exclude or restrict.
Where you are a consumer and Bua constitutes digital content, a digital service or another regulated consumer service, applicable law may give you rights concerning matters such as:
- conformity with the contract;
- supply of the service;
- required updates;
- correction of faults;
- termination;
- price reduction or refund where a price has been paid;
- certain material modifications; and
- information provided before entering a contract.
Those rights apply whether or not every statutory remedy is repeated in these Terms.
If there is a conflict between these Terms and a mandatory consumer right, the mandatory right prevails.
The fact that Bua may currently be provided without a monetary charge does not mean that applicable consumer protections can automatically be disregarded.
28Our responsibility to you
Bua will provide the service with the level of care and skill required by applicable law.
We are responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or our failure to use the level of care required by law.
We are not responsible for a loss merely because it happened while you were using Bua.
In particular, subject always to your mandatory rights, Bua is not responsible for:
- an inaccurate statement entered by another User;
- a sporting, selection or disciplinary decision made by a Team;
- a medical or return-to-play decision made by a User, Team or healthcare professional;
- an injury caused by participation in training or sport merely because information about that activity appeared in Bua;
- conduct of another User that Bua could not reasonably have prevented;
- loss resulting from you deliberately giving another person access to your account;
- failure of your own device, connection or software; or
- consequences that could not reasonably have been foreseen when the contract was made.
This does not excuse Bua from responsibility where the relevant loss was caused by Bua's own breach, negligence or failure to comply with a statutory obligation.
What we do not exclude
Nothing in these Terms excludes or restricts liability where it would be unlawful to do so.
In particular, nothing is intended to exclude liability for death or personal injury caused by Bua's negligence, fraud or fraudulent misrepresentation, or any mandatory consumer or data-protection liability that cannot lawfully be excluded.
Business loss
If you use Bua wholly or mainly for purposes relating to your trade, business or profession and you are not acting as a consumer, Bua will not be responsible for purely commercial losses such as loss of profit, revenue or business opportunity to the extent that applicable law allows.
Any more detailed B2B allocation of liability between Bua and a Team should be dealt with in Bua's separate agreement with that Team rather than imposed on individual Players through these Terms.
29No general User indemnity
These Terms do not impose a broad indemnity on individual Users.
You remain responsible under ordinary law for your own unlawful conduct, infringement of another person's rights, or deliberate misuse of Bua.
Nothing in this section creates liability where applicable law would not otherwise impose it.
30Complaints and support
If something is wrong with Bua, or you wish to raise a complaint, contact:
Please include enough information for us to understand the issue, but avoid emailing sensitive health information unless it is genuinely required.
We will aim to acknowledge and deal with complaints within a reasonable period.
If a complaint concerns something controlled by your Team — such as selection, the reason a Team requested a check-in, or who was assigned a Team role — we may refer the issue to the Team where appropriate.
If it concerns how Bua operates the service or handles matters for which Bua is responsible, we will deal with that aspect ourselves.
Nothing in this complaints process prevents you from exercising a statutory right or using another remedy available under law.
31Changes to these Terms
We may update these Terms where reasonably necessary to reflect:
- changes to Bua's functionality;
- changes in law or regulation;
- security requirements;
- new ways in which the service is provided;
- changes required by an app marketplace; or
- a legitimate change to Bua's business model.
We will not use this clause to rewrite the contract arbitrarily or retrospectively remove rights that have already arisen.
Where a change is material, we will give reasonable advance notice where practicable, normally through the app, by email or both.
If a material change substantially disadvantages you, we will explain any right you have to stop using or terminate the affected service before the change takes effect.
Urgent changes required by law or security may need to take effect sooner.
The current version and effective date will be identified at the beginning of these Terms, and Bua should maintain records showing which version a User accepted.
32Notices
We may send service-related notices through:
- the Bua app;
- push notification;
- the email address linked to your account; or
- another contact method you have provided for that purpose.
You are responsible for keeping your contact details reasonably current.
A notice relating to an important contractual change will be provided in a form appropriate to the significance of the change and any requirements of applicable law.
33Transferring these Terms
You may not transfer your personal Bua account to another person.
Bua may transfer its rights and obligations under these Terms as part of a genuine corporate restructuring, financing, merger, acquisition or transfer of the Bua business, provided that doing so does not unlawfully reduce your rights.
Where a transfer materially affects your rights, we will give any notice required by applicable law.
Personal data involved in a corporate transaction will be handled consistently with the Bua Privacy Policy and applicable data protection law.
34If part of these Terms is invalid
If a court or competent authority finds that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply so far as they can operate independently.
Any invalid provision will apply only to the maximum extent lawfully permitted and will not be interpreted as giving Bua a right it could not lawfully have.
35No waiver
If we do not immediately enforce a provision of these Terms, that does not mean we have permanently given up the right to rely on it.
Equally, a single decision by Bua to make an exception for one User does not automatically change these Terms for everyone else.
36Entire agreement and other documents
These Terms govern your individual use of Bua.
Other documents may also apply, including:
- the Bua Privacy Policy;
- any separate consent requested for health information;
- applicable app-store terms; and
- a separate agreement between Bua and your Team.
The Privacy Policy is a transparency notice about the handling of personal data and should not be treated as contractual consent to processing.
Nothing in this section excludes liability for fraud or misrepresentation or overrides mandatory information given to you under consumer law.
37Governing law and courts
These Terms are governed by Irish law.
If you are a consumer, this choice of law does not deprive you of any mandatory protection that applies to you under the law of your habitual country of residence.
Any dispute may be dealt with by the Irish courts, subject to any mandatory consumer-jurisdiction rules that give you the right to bring proceedings elsewhere.
If you are not a consumer, the courts of Ireland will have jurisdiction in relation to disputes arising from these Terms unless Bua and you agree otherwise in writing.
